TERMS OF SALE

These Terms of Sale govern every purchase made on the Ovahug store. They sit alongside our Terms of Service, our Shipping Policy and our Refund Policy, which together form the whole agreement between us.
The seller is Vibora Group LLC, a limited liability company registered in the State of New Mexico, United States, trading as Ovahug, with its registered office at 8206 Louisiana Blvd NE, Ste A #9874, Albuquerque, NM 87113, EIN 98-1953441. In these terms "we" and "the seller" mean Vibora Group LLC, and "you" means the person placing the order.
1. SCOPE
These terms apply to consumers buying for personal use. We do not sell wholesale and may decline orders that appear to be for resale. By clicking the payment button you confirm that you have read these terms, that you are at least 18 years old, and that you are ordering to an address in the United States.
2. PRODUCT INFORMATION
Each product page describes the product, its features (heat levels, massage modes, battery and charging) and what is included in each pack. Photographs and videos are representative; colors may look slightly different on your screen. Videos marked as dramatizations show typical use and are not a guarantee of results.
3. HOW A CONTRACT IS FORMED
Placing an order is an offer to buy at the price displayed. The order confirmation email we send after checkout acknowledges receipt of that offer and does not by itself form a contract. The contract is formed when we send you a dispatch confirmation with a tracking number. Until then we may decline the order, in particular where the price shown was obviously wrong, where our fraud screening flags the transaction, or where the delivery address is outside the United States. If we decline, we refund you in full within 3 business days.
4. PRICES AND PROMOTIONS
Prices are shown in US dollars and are the prices in force when you place your order. They exclude sales tax, which is calculated at checkout from your delivery address where it applies. A crossed-out price shown next to the current price is our regular selling price for that item; the lower price is a promotional price for a limited time. Free gifts offered with a pack, such as sleep masks, are only available while the promotion runs and have no cash value.
5. PAYMENT
We accept the payment methods displayed at checkout. Payment is processed by Shopify Payments and its underlying processors; we never receive or store your full card number. Payment is taken in full when you order, and your order is processed once payment is authorized. If a payment is reversed or charged back without contacting us first, we may pause fulfillment while we resolve it, and we will always try to reach you by email first.
6. AVAILABILITY
If an item turns out to be unavailable after you have paid, we tell you within 2 business days and give you the choice between waiting for restock or a full and immediate refund.
7. DELIVERY, RISK AND TITLE
Delivery terms, times and costs are set out in our Shipping Policy, which forms part of these terms. Shipping is free and delivery takes 5 to 8 business days from dispatch within the United States. Risk of loss and title pass to you when the carrier delivers the parcel to the address you gave us; our Shipping Policy nonetheless commits us to reship a parcel lost or stolen after a delivery scan. Delivery times are estimates given in good faith, not guaranteed dates.
8. 2-CYCLE MONEY-BACK GUARANTEE
You can try Ovahug for two full cycles, 60 days from delivery. If it doesn't make day one easier for you, you can return it for a refund of the price you paid, under the conditions set out in our Refund Policy, which forms part of these terms.
9. FAULTY, DAMAGED OR INCORRECT GOODS
If a product arrives damaged, defective, incomplete or different from what you ordered, tell us within 30 days of delivery and send a photograph. We replace it at our cost, or refund the affected item if a replacement is not possible. This is in addition to, and does not limit, any right you have under the law of your state.
10. WHAT THE PRODUCT IS, AND IS NOT
Ovahug is a wearable heat and massage pad for personal comfort. It is not a medical device and it is not sold on the basis that it will diagnose, treat, cure or prevent any disease or condition. Section 6 of our Terms of Service, on safe use and health, applies to every sale.
11. FORCE MAJEURE
Neither party is liable for a failure to perform caused by an event outside its reasonable control, including natural disaster, fire, epidemic, war, civil unrest, strike, carrier failure, or failure of a public utility or telecommunications network. If such an event prevents us from delivering, we refund you in full.
12. LIMITATION OF LIABILITY
Our liability under any single order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence, or for fraud.
13. NO WAIVER, SEVERABILITY
If we do not enforce a term on one occasion, that is not a waiver of it. If a court finds a term unenforceable, the remaining terms stay in force.
14. GOVERNING LAW
These Terms of Sale are governed by the laws of the State of New Mexico, without regard to conflict of law rules, and the courts of Bernalillo County, New Mexico have jurisdiction. This does not deprive you of the protection of any mandatory consumer law of the state in which you live.
